  21. How to Contact Us

1. Acceptance of These Terms

By accessing this website, sending a message through our contact form, calling the yard, or authorizing a crew to perform work, you confirm that you have read and understood these Terms of Service and that you agree to be bound by them. If you are acting for a property owner, a landlord, a tenant, a homeowners association, or a real estate transaction, you confirm that you have the authority to accept these terms on behalf of the property and the parties you represent.

If you do not have that authority, or if you do not agree with any part of these terms, you should not request service. These terms remain in effect for as long as you use the website or maintain a service relationship with the company.

2. Services Provided

UNCLE DUKES SEPTIC AND DRAIN LLC provides septic tank pumping, drain line clearing, system inspections, riser and lid installation, hydro jetting, and real estate sale inspections. The company serves the north Phoenix valley and surrounding communities from its yard at 2605 W Dove Valley Rd APT 113, Phoenix, 85085-5202, United States (US).

The scope of any particular job is determined by the work you request and by what the crew finds on arrival. A service described on this website is an offer to perform that category of work, not a promise that every property is a candidate for it. The crew may recommend a different approach if site conditions make the requested method unsafe, ineffective, or unsuitable for the pipe or tank involved.

3. Quotes and Estimates

Prices quoted by telephone or through the website are estimates based on the information available at the time. Final charges may differ if the actual condition of a tank, a line, or a property differs from what was described. Common reasons for a change include a tank that is larger than expected, a lid that must be excavated, a line that requires jetting after cabling, or access that requires additional labor.

When a change in scope becomes apparent, the crew will explain the situation and the expected cost before proceeding, unless the change is minor and necessary to complete the requested service safely. A verbal or written authorization from the customer, or from an adult present at the property, constitutes approval of the additional work.

4. Scheduling and Access

Service windows are provided in good faith and depend on traffic, weather, crew availability, and the duration of earlier jobs. We make reasonable efforts to arrive within the promised window, but we do not guarantee an exact arrival time. If a delay occurs that materially affects your day, the office will contact you using the details on file.

You agree to provide safe and reasonable access to the tank, the cleanout, and the work area. This includes unlocking gates, moving vehicles, securing pets, and clearing stored items from the path the crew must use. If access cannot be obtained, the visit may be treated as a trip charge, because the crew and equipment were dispatched and could not perform the work.

5. Payment Terms

Payment is due upon completion of the work unless other arrangements have been agreed in writing before the service begins. We accept the payment methods described by the office at the time of scheduling. For certain commercial accounts and property management clients, invoicing terms may be offered at the discretion of the company.

If an invoice is not paid when due, the company may suspend further service, assess reasonable late charges permitted by law, and take steps to collect the amount owed. You agree to pay any reasonable costs of collection, including attorney fees where allowed, if an account must be referred for collection. Questions about an invoice should be raised promptly so the office can review the record.

6. Cancellation and Rescheduling

We understand that plans change. If you need to cancel or reschedule, please contact the office as early as possible so the time can be offered to another customer. Cancellations made with reasonable notice are handled without charge. A cancellation made after a crew has been dispatched, or a customer who is not present when access was promised, may be subject to a trip charge that reflects the cost of the wasted visit.

The company may also reschedule a visit when weather, safety, or equipment conditions make the work unsafe or impractical. In that case, we will offer the next available appointment and will not charge for the rescheduling.

7. Customer Responsibilities

The customer is responsible for providing accurate information about the property and the system, including the location of the tank and any cleanouts, the age of the system, and any known hazards on the site. The customer is also responsible for disclosing anything that could affect the safety of the crew, such as aggressive animals, unstable ground, electrical lines, or recent excavation.

The customer agrees not to pour hazardous materials into the system and to use the system in the manner for which it was designed. Flushing wipes, pouring solvents, or routing storm water into a septic system can damage the system and may void any warranty or goodwill consideration the company might otherwise offer. The customer remains responsible for the condition of the system between service visits.

8. Site Conditions and Hidden Hazards

Septic work often involves buried infrastructure whose exact condition cannot be known until it is uncovered. The company is not responsible for damage that results from conditions it could not reasonably foresee, including collapsed pipes, deteriorated tanks, unmarked utilities, or buried debris. When a crew encounters an unexpected condition, work will pause so the customer can be informed and a decision can be made.

The customer is responsible for locating and marking private utilities on the property, such as irrigation lines, landscape wiring, and private water lines. Public utilities are located through the established call-before-you-dig process where applicable, but private lines remain the responsibility of the property owner.

9. Permits and Compliance

Some work, including certain installations and repairs, may require a permit or inspection by a local authority. Unless the company agrees in writing to obtain a permit, the customer is responsible for determining whether a permit is required and for obtaining it. The company will perform its work in a manner consistent with applicable codes and industry practice, but it does not assume the customer obligation to secure approvals.

Where a jurisdiction requires that a licensed contractor perform specific work, the company will either provide that service within its qualifications or advise the customer that another licensed trade must be engaged. The company will not perform work outside the scope of its authorization.

10. Warranties and Disclaimers

The company warrants that its work will be performed in a professional manner consistent with industry standards for the type of service requested. This is the extent of the warranty unless a separate written warranty is provided for a specific job. The company does not warrant that a drain line will never clog again, that a tank will never need service again, or that a system will last for any particular period, because those outcomes depend on factors outside the companys control, such as household habits, root growth, and the age of the system.

To the fullest extent permitted by law, the website and its content are provided as they are, without additional warranties of any kind, whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Some jurisdictions do not allow the exclusion of certain warranties, so part of this section may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, UNCLE DUKES SEPTIC AND DRAIN LLC is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost use of a property, or the cost of substitute services, arising out of or related to the service or the website, even if the company was advised that such damages were possible.

The total liability of the company for any claim arising out of a service visit is limited to the amount paid by the customer for that service, except where a different limit is required by applicable law. Nothing in these terms limits liability that cannot be limited by law, and nothing here is intended to waive rights that a consumer holds under mandatory local law.

12. Indemnification

You agree to indemnify and hold harmless UNCLE DUKES SEPTIC AND DRAIN LLC, its owners, employees, and agents from any claim, loss, liability, cost, or expense, including reasonable attorney fees, that arises from your breach of these terms, your misuse of the website, your failure to disclose a hazard or accurate information about a property, or your violation of any law or the rights of another party.

This obligation survives the completion of any service and the end of any relationship between you and the company.

13. Property Damage Claims

If you believe the company caused damage to your property during a service visit, please notify the office promptly and allow the company a reasonable opportunity to inspect the condition. Prompt notice helps preserve evidence and allows a fair review. Claims raised long after the work is complete are difficult to evaluate and may be limited by the passage of time.

The company will review every good-faith claim carefully and will resolve it as the facts and applicable law warrant. Nothing in this section is intended to discourage a customer from raising a legitimate concern.

14. Acceptable Use of the Website

You agree to use this website only for lawful purposes and in a manner that does not interfere with its operation or the use of it by others. You may not attempt to gain unauthorized access to any part of the site, introduce malicious code, scrape content at a volume that burdens the server, or use the site to send unsolicited commercial messages or false service requests.

Automated tools that query the site faster than a human visitor, attempts to probe for vulnerabilities, and any effort to impersonate the company or its staff are prohibited. You also agree not to use information from this site to mislead a third party into believing that you are affiliated with the company when you are not.

We may restrict or block access to the website for any user who violates these terms or whose activity creates a risk to the site, its visitors, or the company.

15. Intellectual Property

The text, layout, graphics, and other content of this website are owned by UNCLE DUKES SEPTIC AND DRAIN LLC or used with permission, and they are protected by applicable intellectual property law. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, distribute, or create derivative works from the content for commercial purposes without prior written permission from the company.

The company name, its service marks, and any associated logos remain the property of the company. Nothing on the site grants you a license to use those marks without written consent.

If you believe that content on this website infringes a right you hold, please contact the office with enough detail for us to review the concern, including a description of the material and the basis of the claim. We will review every such notice and respond appropriately.

16. Third Party Content and Links

The website may reference or link to content provided by third parties, such as maps, review platforms, or payment services. The company does not control that content and is not responsible for its accuracy, availability, or practices. A link does not imply endorsement, and your use of a third-party service is governed by the terms and privacy policy of that service.

If you believe a link on our site is broken, misleading, or inappropriate, please let the office know so we can review it.

Third-party content may also appear in the form of reviews or ratings that customers leave on independent platforms. Those reviews belong to the reviewers and the platforms that host them, and we do not control or edit them. If you rely on a third-party review, you do so under the terms of that platform rather than under these terms.

17. Privacy and Information

Our handling of personal information is described in our Privacy Policy, which is incorporated into these terms by reference. By using the website or engaging our services, you consent to the collection and use of information as described in that policy. A copy of the Privacy Policy is available on this website and from the office on request.

If there is a conflict between these terms and the Privacy Policy on a matter concerning personal information, the Privacy Policy governs that specific matter.

18. Force Majeure

The company is not liable for a delay or failure to perform that is caused by events beyond its reasonable control. Such events include severe weather, flooding, extreme heat, utility failures, supply shortages, labor disruptions, road closures, and public health emergencies. When such an event occurs, the company will make reasonable efforts to notify affected customers and to reschedule service as soon as conditions allow.

This provision does not excuse a failure to pay amounts already owed for work that was completed.

19. Governing Law and Disputes

These terms are governed by the laws of the State of Arizona and the applicable laws of the United States, without regard to conflict of law rules. Any dispute arising out of these terms or out of a service visit will be brought in a court of competent jurisdiction located in Arizona, unless applicable law requires a different forum.

Before pursuing formal action, both parties agree to make a good-faith effort to resolve the matter through direct discussion. Many concerns can be settled quickly with a phone call to the office. If a dispute cannot be resolved informally, each party retains the rights available under law.

20. Changes to These Terms

The company may update these Terms of Service from time to time to reflect changes in its services, its practices, or the law. When a material change is made, the effective date at the top of this page will be revised. Continued use of the website or engagement of services after an update constitutes acceptance of the revised terms.

We encourage you to review this page periodically. If you do not agree with a change, you may contact the office with your concerns or choose not to use the affected service.
